Professional Practice System Resolution

The Trustees hereby establish, by this Resolution, a Professional Practice System (the System) for Biomagnetics as researched and taught by the Foundation.

The System is headed by an Oversight Officer who is a Trustee-Senior Director with overall control of the system. The Oversight Officer shall work with the other Trustees and the Ethics, Certification, IRB and Peer Review chairpersons, Editor-in-Chief and Webmaster, with the advice of the Institute Counsel.

Whereas the Foundation for Magnetic Science (herein, FMS) is a nonprofit corporation duly recognized under state and federal law, and

Whereas the By-Laws, Paragraph 6(9). Provide, in part, that the Trustees shall:

"...establish courses of study and professional requirements... for Biomagnetic and other magnetic science practices, including Health Care...; to establish boards and committees to operate same; to certify Research Associates... (to be known as Biomagnetic Research Professionals, BmRP... (and to issue, suspend or terminate any Certification for cause); and to establish, by Rule, peer-review procedures, web sites, associations, an Ethics Code and procedures, and forms and structures for professional practice under the oversight of the Board; all Certifications shall be issued by the Chairperson as Chief Executive Officer under authority of the Board. A certified health care practitioner may be referred to as a Board Certified Biomagnetic Research Practitioner, or BCBmRP."

Therefore, the Trustees have unanimously adopted the following Rules and Regulations to govern the Oversight Officer, Certification Board, Institutional Review Board (IRB), Editorial Board (Journal/Website) and Ethics Board matters. The Board of Trustees through the Oversight Officer may carry-on the functions of any of these Subsidiary Boards, at any time, if in the Trustees' discretion, such body is not functioning or is not functioning in the best interests of Biomagnetics. The Chairpersons of the Subsidiary Boards, including the Editor-in-Chief and the Webmaster, report to the appropriate Oversight Officer.

1. FMS's Trustees, through the Oversight Officer, will formally issue or withdraw such Certifications upon the recommendations of the Credentialing Bodies established by this Resolution and under the signature of the Chairperson.

2. There are hereby established the following Boards and activities within FMS: (1) an Oversight Officer (2) an Ethics Board (3) a Certification Board, (4) a Journal Editorial Board and (5) an Internal Review Board and such IRB and Peer review boards as may be advisable. To be eligible for membership in the Boards or other bodies created hereunder, a person shall have been involved in Biomagetics practice, education and research for at least one year and shall be in current good standing under the Certification Standards.

3. The Board and subsidiary bodies have the following Missions -

(a) Oversight Officer - a Trustee-Senior Director with general oversight. The Oversight Officer implements the recommendations of the subsidiary bodies and recommends the issuance or withdrawal of Certifications.

(b) Ethics Board - implements the Code of Ethics (C/E) upon receiving complaints from clients; has authority to recommend that the Trustees decertify, suspend or withdraw Certifications; also hears appeals regarding Certification issues and Journal peer review issues. The Board consists of an Ethics Chairperson appointed and removable by the Oversight Officer and such Members (not exceeding six) as may be invited by the Board Chairperson. The Chairperson and Members of the Board may be removed from the Board by resignation or determination of the Board of Trustees. The Ethics Code and Ethics Enforcement Rules, attached hereto, are hereby adopted. They include:

(i) the Code of Conduct, a short statement of principles and injunctions about proper professional behavior (suitable for display unaltered) and

(ii) Ethics Enforcement Code that details how complaints are made, considered and appealed, and the consequences of a Finding of Unethical Behavior; also, procedures for Certification and Peer Review appeals.

(d) Certification Board (may also be referred to as: Board for Professional Certification Standards) - implements the Certification Standards to recommend the issuing of various degrees of certification to Research Practitioners (existing practitioners to be ‘grandfathered' and life experiences to be considered along with academics and professional status). Certification to cover Biomagnetics as established by the research initiated by Peter A. Kulish and continued by the Foundation. The Board consists of a Certification Chairperson appointed and removable by the Oversight Officer and such Members (not exceeding six) as may be invited by the Board Chairperson. The Chairperson and Members of the Board may be removed from the Board by resignation or determination of the Board of Trustees.

(e) Editorial Board - publishes the Journal on line (and downloadable) at the FMS site, to replace the current of practice of publishing individual articles on the site without peer review. The Journal publishes in the area of Biomagnetics as established by the research initiated by Peter A. Kulish and continued by the Foundation. The Board consists of an Editor-in-Chief and a Webmaster appointed by the Trustees upon the advise of the Oversight Officer and such Members (not exceeding six) as may be invited by the Editor-in-Chief. The Editor-in-Chief, Webmaster and any Member may be removed from the Editorial Board by resignation or determination of the Board of Trustees; Members serve at the pleasure of the Editor-in-Chief. Editorials in the Journal are subject to Peer Review and Editorial Board approval; Journal articles, comments and notes are subject to approval by the Editor-in-Chief. The Webmaster shall be responsible for web site content under the general direction of the Editor-in-Chief. The attached Peer Review Standards are adopted by the Board of Trustees.

(f) Internal Review Board (IRB) - adopts Guidelines for Research and oversees and reviews all research, carrying on the normal duties of an IRB under the direction of the IRB Chairperson; the Chairperson may appoint such Review Boards as may be required to oversee the research projects. The IRB consists of an IRB Chairperson appointed and removable by the Oversight Officer and such Members (not exceeding six) as may be invited by the IRB Chairperson. The Chairperson and Members of the Board and Subsidiary IR Boards may be removed from the Board by resignation or determination of the Board of Trustees. The IRB Guidelines attached hereto are adopted by the Board.

(g) Peer Review Board - approves Articles for publication under the Peer Review Standards. The Peer Review Board consists of a Peer Review Chairperson appointed and removable by the Oversight Officer and such Members (not exceeding six) as may be invited by the Peer Review Chairperson. The Chairperson and Members of the Board may be removed from the Board by resignation or determination of the Board of Trustees. The Peer Review Standards attached hereto are adopted by the Board.

4. Practitioners who are in compliance with the standards established under this Resolution, upon receipt of their signed certificate, are considered to be Board Certified in good standing, eligible for referrals, may participate in continuing education and forums, and are eligible for research support. The Oversight Officer oversees general practitioner matters and communications.

5. The Board of Trustees reserves all rights, including the right to amend this Resolution.
